1. The KTF and ownership of rights
1.1 This notice is issued by the Knowledge Translation Foundation NPC, a non-profit company duly incorporated in terms of the Companies Act 71 of 2008 with registration number 2024/333268/08 (the “KTF”), being the entity through which the activities, programmes, resources and intellectual property of the Knowledge Translation Unit are administered, developed and made available.
1.2 All rights, title and interest in and to the Works (as defined in clause 2 below) vest in the KTF and/or its licensors.
2. The Works
2.1 The information and materials made available on or through the KTF’s website at https://knowledgetranslation.co.za, including, without limitation, all PACK-related materials; all KTF systems, platforms, tools and applications, including their underlying computer programs, source code, databases, components, content and associated literary works; and any associated materials distributed through other channels, platforms or third-party systems, constitute original works eligible for copyright protection (collectively, the “Works”).
2.2 The Works are protected under the Copyright Act 98 of 1978 of the Republic of South Africa (the “Act”), and nothing contained on the website or in any of the Works shall be construed as conferring any licence or right of use in respect of the Works, save as expressly provided in this notice or agreed in writing by the KTF.
2.3 The Republic of South Africa is a signatory to the Berne Convention. The Works accordingly enjoy copyright protection not only within South Africa but also in all other member states. Users accessing the Works from outside South Africa are reminded that such access and use remain subject to this notice, to the Act, and to the applicable copyright legislation of the jurisdiction from which the Works are accessed.
3. Reservation of rights and prohibited acts
3.1 No person may reproduce, copy, adapt, translate, modify, create derivative works from, distribute, publish, transmit, display or otherwise exploit the Works, or any part thereof, in any form or by any means whatsoever, whether electronic, mechanical, photographic or otherwise, without written permission of the KTF.
3.2 For the avoidance of doubt, the unauthorised reproduction of the Works, or any part thereof, including the making or distribution of photocopies, scans, screenshots, digital copies or extracts, whether by an organisation or by any individual within an organisation, constitutes an infringement of the rights of the KTF and/or its licensors in terms of the Act.
4. Remedies and enforcement
4.1 The KTF expressly reserves all rights and remedies available to it in law, including the right to approach a competent court for: (i) an interdict restraining any unauthorised copying, adaptation and/or distribution of the Works; (ii) an award of damages, or in lieu of damages, a reasonable royalty, against any infringing entity or person; and (iii) delivery up of all infringing copies of the Works.
4.2 Users are further advised that certain acts of copyright infringement constitute criminal offences in terms of the Act. A person convicted of such an offence may be liable, in the case of a first conviction, to a fine of up to R5 000,00 (five thousand rand) in respect of each article to which the offence relates, or to imprisonment for a period of up to 3 (three) years, or to both such fine and such imprisonment, with increased penalties applicable in the case of any subsequent conviction.
5. Permissions and licensing
5.1 The KTF welcomes engagement with health systems, governments, academic institutions and implementing partners regarding the lawful use, adaptation and localisation of the Works. Requests for permission to reproduce, adapt or otherwise make use of the Works, or any part thereof, should be directed in writing to the KTF at info@knowledgetranslation.co.za, and no such use may commence until written permission has been granted.
6. Notice to organisations
6.1 Organisations accessing or making use of the Works are requested to ensure that every member of, and person engaged by, the organisation is made aware of the KTF’s rights as set out in this notice. The KTF’s rights in the Works subsist for the benefit of the primary healthcare communities it serves, and your assistance in ensuring that those rights are not unlawfully infringed is appreciated.
